Mathnasium Mexico Personal Data Privacy Notice:
Dear, the data processors Mathnasium Franchisor LLC, the main franchise, and Maxibella S.A. de C.V. (hereinafter Mathnasium Mexico) are aware of the importance of properly protecting your personal data. Therefore, in accordance with the “Ley Federal de Protección de Datos Personales en Posesión de los Particulares” (LFPDPPP) (Federal Law on the Protection of Personal Data Held by Private Parties), MAXIBELLA, S.A. DE C.V., with an address at Calle Tiziano, 5286, Eucalipto Vallarta, Zapopan, Jalisco, C.P. 45020, as the responsible entity, makes this Privacy Notice available to you to ensure that you have full knowledge of how your personal data will be processed, as well as to facilitate the exercise of the rights granted to you by the LFPDPPP.
This is because we may collect, use, and share your personal information directly or indirectly through our websites and applications in Mexico in the same manner as applies to Mathnasium Franchisor LLC in its Privacy Policy. The data collectors include all MATHNASIUM® franchised locations in Mexico.
Consent.
It is necessary for the data owner to review this privacy policy before using our website, applications, or submitting information to us. By submitting your personal information to us and/or accessing and using our website or applications, you consent to the collection, processing, use, and disclosure of your information by us or third parties under the terms of this privacy policy and in accordance with Articles 6 and 8 of the “Ley Federal de Protección de Datos Personales en Posesión de los Particulares”.
If we intend to use your personal information for a different purpose, we will obtain your express consent for such use. We will obtain your consent before collecting and processing sensitive, financial, and/or banking personal information, or as required by the “LFPDPPP” from time to time.
The data owner is not required to provide personal information to us. However, without certain information from you, we will not be able to offer our services, and you may be limited in accessing functions of our websites, applications, online platforms, and services.
Collected Personal Data.
Mathnasium Mexico, as the responsible entity, only collects personal data from individuals in the case of some visitors, membership applicants, their students, and their suppliers. In each case, the following personal data is or may be collected:
Visitors: In case visitors are interested in knowing the facilities and services offered by Mathnasium Mexico to its students, the data occasionally collected are: name, address, telephone, email.
Membership applicants parents/guardians: Membership applicants parents/guardians: In the particular case of people interested in enrolling their children either parents or guardians to Mathnasium Mexico, through the acquisition of any of the memberships offered in the Centers, the personal data collected are: name, address, official identification number, telephone, email, emergency contact, emergency phone, for recurring charges and direct debit payments, your bank account information will be collected, credit card or debit card. Mathnasium Mexico, informs you that some of the above mentioned data may be considered sensitive under the terms of the “Ley Federal de Protección de Datos Personales en Posesión de los Particulares”, that its treatment is necessary to fulfill the purposes referred to in the following chapter, and that through the delivery and signing of your “Registration Agreement”, you expressly authorize in writing to treat your personal data under the terms set forth in this privacy notice.
Children: Mathnasium Mexico does not collect, store, share, or use the personal data of children under the age of 16. If you are under 16 years of age, please do not provide any personal data, even if the website asks you to do so. If you are under the age of 16 and have provided personal data, please ask your parent or guardian to notify Mathnasium and Mathnasium will delete all such personal data. The website is not for use by children under the age of 16.
Suppliers: In the case of suppliers who are individuals or legal entities that maintain commercial relations with the franchised MATHNASIUM® Centers in Mexico, the data collected are: name, address, telephone number, Federal Taxpayer Registry number, occupation, bank account data, email, their image in case of access to any of the facilities.
Prospects to Franchisee: If you are a potential franchisee, we may collect detailed information, such as your first name, last name, email address, telephone number, address and general financial information such as liquidity and assets, to evaluate your qualifications to acquire a MATHNASIUM® franchise.
Special Case of the Website: When accessing and browsing the website of Mathnasium Mexico you may send us some personal information in order to schedule an appointment to visit our facilities and/or membership classes. In that case, the data you send is: your name, your email and your telephone number. In the case of the use of your personal data, it will be limited to attending and responding to your request and/or contacting you to offer you the exclusive services of Mathnasium Mexico, observing at all times the personal data protection policies that arise from this privacy notice.
Purposes of processing.
The processing of your personal data will aim to enable the comprehensive development of the specific relationship that you and your child have decided to establish with us, in accordance with the Company’s policies and the applicable contractual and legal provisions. Any processing we perform on your personal data must have a reasonable justification within this general purpose.
For visitors, your personal data will be used to send you information about our memberships, class programs, services we offer, facilities, and/or events that may be of interest to you. Your data is collected when you visit our facilities with a particular interest in getting to know us and becoming part of one of our Centers by acquiring a membership. To fulfill this purpose, Mathnasium México may occasionally use your data to inform you about our promotions and/or new services and to contact you directly to follow up on your interest in joining one of our Centers.
For parents/guardians and membership applicants, Mathnasium México will use your personal data for the following purposes:
- Confirm your identity and contact information.
- Integrate and manage the records of the Data Subjects.
- Manage, together with the Directors of our Centers, the student enrollment process in MATHNASIUM Centers, as well as the corresponding informational and training sessions and participation in the programs taught at these Centers, their systems, platforms, and related portals, including any competitions, recognitions, diplomas, campaigns, and events conducted by the Data Controller and/or taking place at the Centers.
- Evaluate and monitor the quality of services provided to students and parents at the respective MATHNASIUM Center.
- Notify and handle emergencies.
- Provide educational materials, learning resources, and other related items.
- Manage student evaluations concerning their progress and use of the MATHNASIUM system.
- Improve, supervise, and assess the MATHNASIUM system and its proper implementation at the Centers by instructors.
- Personalize and manage the assignment and issuance of recognitions and/or diplomas.
- Send communications from the Center Director with relevant information about the MATHNASIUM system, MATHNASIUM Centers, and/or other related activities.
- Conduct interviews regarding students’ progress at MATHNASIUM Centers.
- Manage your participation in informational sessions, surveys, and/or interviews, as well as conducting them.
- Case studies of the MATHNASIUM system.
- Management and administration of school insurance, discounts, and other privileges.
- Develop and improve MATHNASIUM learning materials and instructional methods.
- Train employees and instructors at MATHNASIUM Centers.
- Provide guidance, clarifications, customer service, and monitor service quality by recording calls and storing corresponding conversations and messages.
- Comply with the legal requirements of national and international competent authorities and fulfill obligations arising from the legal relationship between Data Subjects and the Data Controller and/or its affiliated and subsidiary companies.
- Comply with national or international legal provisions and obligations applicable to the company, its subsidiaries, and/or affiliates, as well as manage any related judicial proceedings.
- Conduct processes related to corporate restructuring, including mergers, consolidations, sales, liquidations, or asset transfers.
- Complementary activities necessary for the realization of the above purposes.
For personal data provided by suppliers, your data will be used to carry out the supplier evaluation, selection, and registration process; receive the products or services you offer; enable the mutual fulfillment of general obligations arising from the commercial relationship with Mathnasium México; analyze the quality of your products and/or services; ensure security and internal control in case of access to the facilities; and any other purpose directly related to those previously mentioned.
Transfers to Third Parties and Disclosure.
Your personal data may be transferred to third parties, provided that such transfer is related to the purposes mentioned above. Such disclosure and/or transfer of your personal information may be national or international, as long as these transfers are necessary and align with the disclosed purposes. These transfers may include, but are not limited to, the “Instituto Mexicano del Seguro Social” (Mexican Social Security Institute) (IMSS), the “Secretaria de Hacienda y Crédito Público” (Ministry of Finance and Public Credit) (SHCP), insurance companies, financial institutions, internal and external auditors of the Company who monitor service quality, and authorities requiring it under legal terms; services in addition to contacting you directly to follow up on your interest in being part of our club.
This may include disclosing your personal information to:
- Our related corporate partners and other associated entities, including, but not limited to, MATHNASIUM INTERNATIONAL FRANCHISING, LLC; Club Wise, S.A. de C.V.; and Edge Billing, S.A. de C.V.
- Our franchises and/or licensees in Mexico, who are contractually bound to maintain your information confidential and may use this information only in accordance with the terms of the contract.
- Our related companies or business partners so that the related company or partner may contact you about offers or information (including offers or information about the products or services of the related company or business partner).
- Third parties to perform administrative or other services on our behalf.
- A third party that acquires the business or assets of any of our entities
- Other service providers and business partners such as administration, technology, auditing, mailing, printing, and professional service providers.
In all cases, we must instruct third parties to whom we transfer or disclose your personal information to use it only in a manner consistent with this Privacy Notice.
We may also disclose your personal information for other purposes with your consent or for any purpose if disclosure is required or authorized by law.
Sensitive personal data will not be transferred unless it is strictly necessary to fulfill the aforementioned purposes or is expressly permitted by law.
Security Mechanisms.
To ensure the proper safeguarding of your personal data and to fully comply with the obligations established by the LFPDPPP (Ley Federal de Protección de Datos Personales en Posesión de los Particulares), Mathnasium México adopts various security measures to protect personal data, such as restricted access to physical and electronic databases; confidentiality commitments assumed under the Company’s internal policies regarding all information accessed by individuals providing services due to their functions; confidentiality clauses with our suppliers (such as electronic data storage providers or off-site document storage providers); restricted access files; confidentiality and liability agreements regarding databases; and adherence to the quality principle reflected in the law.
Personal information is maintained on our servers or storage facilities located in the United States and Mexico.
We will retain your information for as long as necessary to provide you with services and as needed to comply with our legal obligations, resolve disputes, and enforce our agreements, unless retention is required by law.
Objection.
Notwithstanding the above, the Holder has the right at any time to prohibit the data controller from providing and/or transferring their personal data to third parties through the procedure outlined in the following section.
However, it is important to note that we may not be able to fulfill your request or immediately discontinue use in all cases, as legal obligations may require us to continue processing and/or transferring your personal data.

In cases permitted by law, you may access your data, request its rectification, oppose or cancel it, or object to the full or partial processing of your data and revoke previously granted consent as follows:

Your request will be processed within 20 days of receipt, in accordance with the timeframes set by law, and you will be informed of the response to your request. If necessary, Mathnasium México may ask you to expand or clarify the information provided to process your request properly.
